Privacy Teams Are Shrinking. AI Risks Are Exploding. Here Is How Australian Businesses Close the Gap.

ISACA's State of Privacy 2026 survey found the median Australian privacy team shrank from eight people to five — while AI deployments multiplied. With the OAIC compliance sweep underway and a December deadline looming, most businesses are running a serious deficit. Here is the practical path forward.

ISACA's newly released State of Privacy 2026 report surveyed 1,800 privacy professionals globally — including a significant Australian cohort. The headline finding is uncomfortable for any Australian business deploying AI: the median size of privacy teams dropped from eight people last year to five this year. At the same time, 63% of respondents said their roles are more stressful than 12 months ago.

The cause is not hard to identify. AI deployments are generating privacy obligations faster than privacy teams can manage them. Every new AI tool, every agentic workflow, every automated decision affecting customers or employees creates new compliance surface area. But instead of privacy teams growing to match, they are shrinking — through restructuring, budget pressure, and a talent market where experienced privacy professionals are being pulled in multiple directions.

For Australian mid-market businesses, this creates a specific and urgent problem: you are likely running more AI than your privacy team can properly govern, and the regulatory environment is tightening precisely as your capacity to manage it shrinks.

Why This Is an Australian Problem Right Now

The timing of ISACA's finding matters. Three things are happening simultaneously in the Australian privacy and AI landscape:

The OAIC launched its first proactive compliance sweep in January 2026. For the first time, Australia's privacy regulator is not waiting for complaints — it is actively checking. Approximately 60 organisations across financial services, health, retail, telecommunications, professional services, and digital platforms received formal compliance notices. The regulator is looking at AI-related personal data handling specifically.

The Privacy Act's automated decision-making transparency obligations take effect on 10 December 2026. From that date, any APP entity using AI or computer programs to make decisions significantly affecting individuals must disclose the practice, notify affected individuals, and provide meaningful explanations on request. Nine months is a shorter window than it sounds when the remediation involves technical builds, policy updates, and process design.

The 2024 Privacy Act amendments expanded the definition of personal information to include inferred attributes and model outputs about individuals. AI systems that were previously in a grey zone — generating scores, classifications, or recommendations — are now clearly within scope. The compliance surface expanded without a corresponding expansion of compliance teams.

The result: Australian businesses are carrying more privacy risk from AI than they are equipped to manage.

What "Privacy Risk from AI" Actually Looks Like

To understand the gap, it helps to be concrete about what AI systems do that creates privacy exposure.

Scope expansion. An AI model trained on historical customer data may process personal information in ways that were not disclosed in the original collection notice. The model "knows" things about customers that the customers did not realise they were sharing. Under the expanded Privacy Act definition, model inferences about individuals are personal information.

Third-party disclosure. When an Australian business calls an AI API — even a well-known provider — and includes personal information in the input, that is a cross-border data transfer if the provider's infrastructure is offshore. Most businesses using the default OpenAI, Anthropic, or Google API endpoints are making undisclosed offshore transfers of personal information. With a privacy team of five instead of eight, who is checking this?

Automated decision exposure. Loan decisions, insurance claim assessments, job application screening, customer service routing — these are all decisions that AI systems are increasingly making or substantially influencing. Each one creates a potential explanation request from the affected individual. Without an audit trail and explainability layer, the business cannot respond.

Vendor proliferation. AI tools are being adopted faster than vendor assessments can catch up. A marketing team adopts an AI copywriting tool. A sales team adds an AI-powered CRM feature. Finance deploys an AI expense categorisation system. None of these may have gone through a Privacy Impact Assessment. The shrinking privacy team is chasing an expanding shadow.

The Compliance Debt Is Real and Growing

Think of privacy compliance risk the way you think about technical debt: every AI deployment that skips a Privacy Impact Assessment, every data processing activity undisclosed in the privacy policy, every automated decision without an audit trail — these are deposits into a compliance debt account.

The debt compounds. When the OAIC comes checking — and the compliance sweep shows they now do — or when an individual makes a subject access request for data your AI system processed, the bill comes due.

For businesses with a privacy team of five managing AI deployments that previously required a team of eight, the debt is accumulating faster than it can be serviced. The practical question is not whether this is a problem — it is what you do about it.

Four Approaches That Work at Scale

The businesses handling this best are not necessarily the ones with the largest privacy teams. They are the ones that have structured their approach around the reality of constrained resources.

1. Build Compliance Into the System, Not the Process

The most effective way to manage AI privacy risk with a small team is to not create the risk in the first place. This means choosing AI architecture that is compliant by design rather than auditing for compliance after the fact.

Specifically:

  • Australian-jurisdiction hosting by default. Configure AI systems to run on AWS Sydney, Azure Australia East, or Google Cloud Sydney. Personal data does not cross borders. The Privacy Principle 8 cross-border transfer question disappears.
  • Audit trails built in. Every AI decision logged at build time, not as a retrofit. The explanation capability required by December 2026 is present from day one.
  • Minimal data by design. The AI system processes only the personal information it actually needs. Data minimisation is an architecture decision, not a compliance review.
  • Privacy Impact Assessments before build. Two weeks of assessment before an engagement starts costs a fraction of the remediation cost if a compliance issue is found post-deployment.

When compliance is built into the system, your five-person privacy team is overseeing compliant systems rather than chasing non-compliant ones.

2. Prioritise AI Systems That Affect Individuals

Not all AI systems carry equal privacy risk. A privacy team with limited capacity should apply its attention proportionally to risk.

The highest-risk category: AI systems that make or substantially assist in making decisions significantly affecting individuals. These are the systems subject to the December 2026 transparency obligations. They are also the systems most likely to generate complaints, subject access requests, and OAIC scrutiny.

A practical triage approach:

Tier 1 (highest priority) — Immediate action:

  • AI used in credit or lending decisions
  • AI used in insurance underwriting or claims assessment
  • AI used in hiring or performance management
  • AI used in healthcare triage or clinical support
  • Any AI that controls access to services or determines prices for individuals

Tier 2 (medium priority) — Review within 90 days:

  • AI used in customer service routing or prioritisation
  • AI used in fraud detection that results in account restrictions
  • AI used in content personalisation involving behavioural profiling

Tier 3 (lower priority) — Annual review cycle:

  • AI used for internal productivity (document summarisation, meeting notes)
  • AI used on aggregated, non-personal data
  • AI used where personal data is not processed

With a team of five, triage is how you stay ahead.

3. Use AI to Support Privacy Compliance Itself

There is an obvious irony available: AI can help manage the privacy risk created by AI.

Specifically:

  • Automated privacy policy gap analysis. AI tools can read your current privacy policy and flag discrepancies with your actual data processing activities, producing a structured gap list for human review.
  • Vendor assessment automation. AI can ingest vendor documentation (privacy policies, data processing agreements, subprocessor lists) and flag gaps against Privacy Act requirements, dramatically reducing the manual review time per vendor.
  • Subject access request assistance. When an individual requests their personal data, AI can systematically search data stores and compile a structured response — reducing the hours of manual work per request.
  • Automated decision-making audit log generation. AI systems with proper observability can generate human-readable explanation summaries at decision time, making compliance with the December 2026 obligations operationally manageable.

None of these tools eliminate the need for human privacy judgment. They do eliminate the low-value manual work that consumes privacy team capacity.

4. Embed Privacy Champions in Business Units

A privacy team of five cannot be everywhere. A model that works: each major business unit has a nominated "privacy champion" — not a specialist, but someone who has received basic training and is responsible for flagging new AI tool adoptions before they happen.

The privacy champion does not do compliance reviews. They ensure the privacy team knows about new AI deployments before they go live. This converts the discovery problem (privacy team learning about AI tools months after they are deployed) into a manageable pre-clearance process.

This is low-cost to implement and directly reduces the unseen compliance debt that accumulates through shadow AI adoption.

The December 2026 Deadline: What Your Team of Five Must Deliver

With nine months until the automated decision-making transparency obligations take effect, here is what a constrained privacy team needs to deliver:

Months 1–2 (now through May 2026): Inventory Complete an audit of every AI system that makes or substantially assists in decisions affecting individuals. For each: what decisions, what personal data, what audit trail exists, who owns it.

This is the hard part because it requires engaging every business unit. The privacy champion model helps. Budget for this to take longer than expected.

Months 3–4 (May–July 2026): Gap Analysis For each system in Tier 1 and Tier 2, assess: does it have an audit trail? Can it produce a human-readable explanation? Is the practice disclosed in the privacy policy? Is there a process to respond to explanation requests?

The gap analysis will produce a list of remediation items. Some will be policy changes (cheap). Some will be technical builds (expensive and time-consuming).

Months 5–8 (July–November 2026): Remediation For systems that cannot yet produce explanations or audit trails, work with your AI vendors or implementation partners to build the capability. Update privacy policies. Design the explanation request process and train staff.

Build in time for testing — the explanation request process needs to be exercised before December, not on the first live request.

Month 9 (December 2026): Go-live and monitoring Obligations take effect. Your team monitors incoming explanation requests and handles them per the designed process. Ongoing monitoring for new AI deployments that need to enter the triage process.

What to Do If You Are Already Behind

If you read the above timeline and your honest assessment is "we have not started," there are two practical options:

Option 1: Scale internal capacity temporarily. Contract additional privacy resources — law firms with privacy practices, specialist privacy consultants — for the inventory and gap analysis phases. This is the fastest way to accelerate.

Option 2: Engage an AI implementation partner who bakes compliance in. If you have AI deployments that currently lack audit trails and explainability, the fastest path to compliance is often a rebuild or retrofit with an implementation partner who designs for Privacy Act compliance from the start. This is faster than trying to retrofit compliance into systems that were not designed for it.

For most Australian mid-market businesses, the answer is some combination of both.

The Structural Fix

The ISACA finding — privacy teams shrinking as AI risks explode — describes a gap that will not close by hiring alone. The talent is scarce and expensive. The structural fix is architecture: AI systems that are compliant by design, reducing the ongoing compliance monitoring burden per system.

A Privacy Impact Assessment before an AI build starts. Australian-jurisdiction hosting as the default, not the exception. Audit trails and explainability built in. Minimal data by design.

When compliance is designed in, a team of five can govern it. When it is not, a team of twenty cannot catch up.
