The OAIC Has Started Checking: What Australian Businesses Using AI Need to Know Right Now

In January 2026, the Office of the Australian Information Commissioner launched its first-ever privacy compliance sweep — targeting 60 organisations across six sectors. If your business uses AI to process personal data, here is what that means for you and what to do immediately.

Something changed in January 2026.

The Office of the Australian Information Commissioner — Australia's privacy regulator — launched its first-ever active compliance sweep. Not in response to a specific complaint. Not triggered by a breach. A proactive, regulator-initiated check of approximately 60 organisations across six sectors where personal information is commonly collected.

This is a structural shift in how privacy enforcement works in Australia. For businesses using AI to process personal data, it signals that the era of "we'll deal with compliance when there's a problem" is over.

Here is what happened, what it means, and what you need to do about it.

What the OAIC Actually Did

In January 2026, the OAIC sent formal notices to approximately 60 Australian organisations across financial services, health, retail, telecommunications, professional services, and digital platforms. The notices required those organisations to demonstrate compliance with the Australian Privacy Principles — specifically around how personal information is collected, stored, used, and disclosed.

This is significant for two reasons.

First, it is proactive. The OAIC historically acted in response to complaints and notified data breaches. This sweep is different: the regulator is actively looking, not waiting to be told. That changes the risk calculus for every Australian business that handles personal data.

Second, the sectors targeted are exactly the sectors where AI adoption is highest. Financial services, health, and professional services are where Australian companies have moved fastest with AI implementations — and they are exactly where the privacy risks of AI are most acute.

Why AI Makes This Matter More

Every AI system that processes personal data is subject to the Australian Privacy Principles. But AI creates compliance risks that traditional software does not:

The scope problem. AI systems often process more personal data than the organisation realises. A customer service AI trained on historical support tickets may be processing sensitive information from conversations that occurred years ago. A fraud detection model may be inferring characteristics about individuals from patterns that are not explicitly disclosed in any privacy notice.

The inference problem. The 2024 Privacy Act amendments expanded the definition of personal information to include derived attributes and inferences about individuals. If your AI system is making inferences about customer behaviour, health status, financial risk, or any other personal characteristic — those inferences are personal information, and the Privacy Act applies.

The automated decision-making problem. From 10 December 2026, organisations must be able to explain automated decisions that significantly affect individuals. The OAIC compliance sweep is happening *before* that deadline — which suggests the regulator is assessing baseline compliance readiness, not just waiting for December.

The collection problem. Privacy Principle 3 requires that personal information be collected only if reasonably necessary for a function or activity. AI systems that collect or store data "just in case it's useful for training" are likely breaching this principle.

The Six Sectors Under the Sweep

The OAIC targeted six sectors. If your business operates in any of these, the sweep should be treated as a direct signal:

Financial Services

Banks, non-bank lenders, insurance companies, wealth managers, and financial advisers process enormous volumes of personal data. AI applications in this sector — loan decisioning, fraud detection, risk scoring, personalised advice — create compliance exposure at scale. APRA-regulated entities have additional obligations under CPG 220 on model risk management.

Healthcare

Any health service provider — hospital, clinic, pathology, telehealth — that uses AI for triage, clinical decision support, appointment management, or billing is processing some of the most sensitive personal information that exists. Health information has heightened protections under the Privacy Act.

Retail and eCommerce

Loyalty programmes, personalised recommendations, dynamic pricing, and customer segmentation all involve processing personal data. The AI systems powering these features need to comply with the Privacy Act's collection, use, and disclosure principles.

Telecommunications

Customer data held by telcos — call records, location data, browsing patterns — is comprehensive and sensitive. AI systems using this data for churn prediction, upselling, fraud detection, or network optimisation carry significant compliance exposure.

Professional Services

Law firms, accounting firms, management consultancies, and other professional services firms that use AI for document review, client data analysis, or automated reporting are processing confidential personal information.

Digital Platforms

Any digital platform that processes personal data about Australian users — whether for advertising, personalisation, or platform operations — is subject to the Privacy Act.

What the OAIC Is Looking For

The compliance sweep is not narrowly focused on one issue. Based on the OAIC's published compliance sweep methodology and the scope of the 2024 Privacy Act amendments, the likely areas of inquiry include:

Privacy notices and collection statements. Does your privacy policy accurately describe how you collect personal information, including through AI systems? Does it disclose automated decision-making where applicable?

Data minimisation. Are you collecting only the personal information that is reasonably necessary? AI systems that collect broad data sets for potential future use may fail this test.

Access and correction rights. Can individuals access the personal information you hold about them, including data used in or produced by AI systems? Can they request correction?

Security. Are personal data stores secured appropriately? This includes data used to train AI models and data produced by AI systems.

Disclosure controls. Is personal data being shared with third parties — including AI providers — appropriately? Many Australian businesses are inadvertently disclosing customer data to offshore AI providers in breach of cross-border data transfer requirements.

Automated decision-making transparency. Even before the December 2026 obligations take full effect, the OAIC has indicated it expects APP entities to be *preparing* for those obligations. Organisations that cannot demonstrate any progress toward compliance are at risk.

The Third-Party AI Provider Problem

One area that deserves specific attention: the use of offshore AI providers to process Australian personal data.

When an Australian business uses a US-based AI API (OpenAI, Google, Anthropic, Cohere) to process personal information about Australian individuals, that data is being transferred offshore. Under Privacy Principle 8, this is only permitted if the overseas recipient is subject to a comparable privacy regime — or if the Australian organisation takes responsibility for ensuring the overseas recipient handles the data in accordance with the APPs.

Most Australian businesses have not completed this assessment. Many are in technical breach.

The practical solution: for sensitive personal data, use Australian-jurisdiction processing (AWS Sydney, Azure Australia East, Google Cloud Sydney) and configure AI APIs to avoid data residency issues, or use self-hosted models for the most sensitive processing.

What to Do in the Next 30 Days

If your business uses AI to process personal data and has not conducted a systematic Privacy Act compliance review, here is a prioritised action list:

1. Audit your AI systems against personal data (Week 1) List every AI system your business uses. For each: what personal data does it process? Where does that data go? What decisions does it influence?

2. Check your privacy policy (Week 1) Does your current privacy policy accurately describe your AI use? Does it mention automated decision-making where applicable? If not, it needs to be updated before you have an OAIC inquiry sitting in your inbox.

3. Assess your third-party AI providers (Week 2) For each AI provider you use: where is your data processed? What are their data residency and retention policies? Have you completed a cross-border data transfer assessment?

4. Check your data minimisation posture (Week 2) Are you collecting and retaining only the personal information that is reasonably necessary? AI systems often default to collecting everything — audit this explicitly.

5. Test your access and explanation capability (Weeks 3–4) If an individual asked you to produce all personal information your AI systems hold about them, could you? If a customer asked for an explanation of an automated decision that affected them, could you provide a meaningful one? If the answer to either is "no," you have a gap to close.

The December 2026 Deadline Context

The OAIC compliance sweep is happening eight months before the mandatory automated decision-making transparency obligations take effect on 10 December 2026. That timing is not coincidental.

The regulator is effectively creating a baseline: if you receive a compliance sweep notice now and cannot demonstrate you are moving toward December 2026 compliance, that will inform any subsequent enforcement action.

Organisations that have completed their compliance programme ahead of the deadline — and can demonstrate an audit trail, an explanation capability, and an updated privacy policy — are in a substantially different risk position than those who have not started.

The Honest Assessment

The OAIC compliance sweep is not the end of the world. It is a signal from the regulator that passive compliance posture is no longer acceptable for organisations operating AI systems at scale.

Most compliance gaps are fixable. The work is an inventory of your AI systems, an assessment of your privacy policy, a technical build to add audit trails and explainability, and a process to handle individual requests. For a well-scoped AI implementation, this is a 4–6 week programme.

The businesses that are in trouble are those that have deployed AI systems broadly, have no structured approach to Privacy Act compliance, and are now discovering they have more exposure than they realised.
